Construction Access and Impact Policy

Recently the Board of Governor’s adopted a formal policy that protects Black Point-owned property that may be impacted by construction activities undertaken by property owners on adjacent lots. This policy – the Construction Access and Impact Policy – intends to provide guidance to Members requiring such use, while protecting Black Point owned property for the continued enjoyment of all.

Many lots at Black Point are small and some are located adjacent to some of the access ways along the waterfront or border on the Clubhouse, parking lot, or tennis court properties. The Board recognizes that in order to properly complete a project on your property, there may be a need for contractors and their machinery to access your property by traveling over Black Point property. Depending on the nature of the project, that access may impact the Black Point property and the Board wants to ensure that owners will return impacted Black Point property to existing or better condition. This policy formalizes the processes necessary for granting the permission and ensuring the restoration of Black Point property.

Through this policy, the Board has created a new role – Access Supervisor. This role (currently filled by Jim Ventres, who also serves as our Zoning Enforcement Officer) is responsible for providing preliminary guidance on what triggers the policy and what materials to include in the application seeking formal approval. In some cases, the Access Supervisor may determine that the work does not have a negative impact and thus no approval is required. For those projects which will have an impact on shared community property, for everyone’s protection the process requires formal documentation from architects, engineers, and/or contractors including scope of work and required permits. Those completed applications will be reviewed by the Board at a regularly scheduled meeting, or sooner in emergency situations. Once the application is approved, work may proceed. Ultimately, the Access Supervisor will monitor the work to ensure compliance with all conditions and requirements and issue a certificate of completion.
